Welcome to Over and Beyond Travel, LLC (“Agency,” “we,” “our,” or “us”). We are pleased to assist you with your travel arrangements. These Terms and Conditions (“Agreement”) outline the services we provide and the expectations governing your booking.

By submitting payment and/or signing this Agreement, you acknowledge that you have reviewed, understand, and agree to these Terms and Conditions, along with any supplier-specific terms and conditions provided prior to payment.

PAYMENT AUTHORIZATION & CHARGEBACK POLICY

By submitting payment, you authorize Over and Beyond Travel, LLC to charge the credit card or bank account listed on your invoice for the authorized amount related to your selected travel services.

You certify that you are the authorized cardholder or account holder and that all payment information provided is accurate.

Traveler agrees not to initiate improper or fraudulent chargebacks for services authorized and provided pursuant to this Agreement. In the event of an unauthorized or improper chargeback, traveler agrees to reimburse Over and Beyond Travel, LLC for any costs, fees, expenses, attorney fees, or administrative expenses incurred in disputing or responding to such chargeback.

Accepted forms of payment include ACH/checking account payments, Visa, Discover, Mastercard, and American Express. Cash payments are not accepted.

Clients may submit payment through ACH/checking account transactions when available, which generally do not incur processing fees. Certain trips, suppliers, payment platforms, or group bookings may require credit or debit card payments that are subject to nonrefundable payment processing or merchant fees. Any applicable processing fees will be disclosed prior to payment and are nonrefundable once the transaction has been processed.

PAYMENT PLANS, MISSED PAYMENTS & REINSTATEMENT FEES

For reservations utilizing a payment plan, travelers are expected to make regular monthly payments sufficient to keep the reservation in good standing and on track for final payment deadlines.

While travelers may pay more than the suggested monthly amount at any time, failure to maintain regular monthly payments may place the reservation at risk of cancellation, supplier penalties, loss of promotional pricing, or loss of reserved inventory.

A missed monthly payment occurs when no payment is received within the scheduled monthly payment period.

If two consecutive monthly payments are missed, a $25.00 administrative reinstatement fee may be added to the reservation balance to continue participation in the payment plan and maintain the booking.

Over and Beyond Travel, LLC reserves the right to cancel reservations for nonpayment or failure to maintain payment arrangements. Any supplier-imposed penalties, cancellation fees, reinstatement fees, or nonrefundable deposits shall remain the responsibility of the traveler.

Payment reminders may be provided as a courtesy; however, travelers remain solely responsible for monitoring and submitting payments by all applicable due dates.

PROFESSIONAL PLANNING & SERVICE FEES

Professional planning, consultation, itinerary design, research, administrative coordination, supplier communication, and group management fees charged by Over and Beyond Travel, LLC are separate from supplier charges and represent compensation for professional time and services rendered.

Unless otherwise stated in writing, all professional planning and service fees are non-refundable and non-transferable once paid. These fees are earned upon receipt and are not contingent upon supplier refunds, travel completion, traveler participation, or cancellation.

PASSPORTS, VISAS & TRAVEL DOCUMENTATION

Travelers are solely responsible for obtaining and maintaining all required travel documentation, including valid passports, visas, identification, vaccination records, testing documentation, and any other entry requirements applicable to their destination(s).

Passports should be valid for at least six (6) months beyond the traveler’s return date and should contain the required blank pages for entry stamps where applicable.

Any travel information provided by Over and Beyond Travel, LLC is intended for U.S. citizens only. Non-U.S. citizens are responsible for verifying travel requirements directly with the appropriate consulates or government authorities.

Travelers are encouraged to review official government websites, airline requirements, and destination entry regulations prior to departure, as requirements may change without notice.

TRAVEL PROTECTION

Travel protection is strongly recommended to help protect travelers against unforeseen circumstances including trip cancellation, interruption, medical emergencies, baggage delays, supplier penalties, and travel disruptions.

Travel protection may be offered for convenience; however, it is the traveler’s responsibility to accept or decline coverage at the time of booking.

Without travel protection, payments may be subject to supplier penalties and may be non-refundable and non-transferable.

COVID-19 & HEALTH REQUIREMENTS

Travelers are responsible for reviewing and complying with all current health, testing, vaccination, quarantine, and entry requirements imposed by airlines, suppliers, destinations, and government authorities.

Over and Beyond Travel, LLC is not responsible for denied boarding, denied entry, missed travel, quarantine requirements, or supplier penalties resulting from incomplete, inaccurate, or missing travel documentation or failure to comply with travel requirements.

Travelers should consult their healthcare provider, the Centers for Disease Control (CDC), and the World Health Organization (WHO) for current health recommendations.

TRAVEL DOCUMENT DELIVERY

Provided full payment is received by the final payment due date, travel documents and instructions will generally be sent electronically within approximately thirty (30) days prior to departure.

CANCELLATION POLICY

All deposits, planning fees, and service fees are non-refundable and non-transferable unless otherwise stated in writing.

Cancellation requests must be submitted in writing. Refund eligibility is subject to supplier rules, penalties, and restrictions.

No refunds will be provided for:

• unused services;
• missed portions of travel;
• voluntary changes;
• denied boarding;
• failure to possess required documentation;
• or traveler decisions not to travel.

Supplier cancellation penalties may apply immediately upon booking.

HOTEL ACCOMMODATIONS & CHECK-IN POLICY

Over and Beyond Travel, LLC is not responsible for hotel-imposed fees, resort fees, room taxes, incidental deposits, parking fees, or other charges collected directly by the property.

Room assignments, bedding configurations, adjoining rooms, upgrades, and special requests are subject to supplier availability and are not guaranteed.

Hotel check-in and check-out times are determined solely by the property.

TRAVELER RESPONSIBILITY

Traveler is responsible for carefully reviewing all invoices, itineraries, supplier terms, booking confirmations, and travel documents immediately upon receipt.

Traveler is responsible for:

• verifying all names, dates, and travel details;
• arriving on time for flights, cruises, transfers, tours, and scheduled activities;
• understanding supplier policies and restrictions;
• complying with all travel requirements;
• and maintaining proper travel documentation.
   

Failure to review documents or comply with travel requirements shall be the sole responsibility of the traveler.

CODE OF CONDUCT – GROUP TRAVEL

Travelers participating in group travel experiences are expected to conduct themselves respectfully and responsibly at all times.

Disruptive, unsafe, threatening, abusive, discriminatory, intoxicated, unlawful, or inappropriate behavior toward travelers, staff, suppliers, or local personnel may result in denied participation, removal from activities, transportation, accommodations, or the trip itself without refund.

Over and Beyond Travel, LLC reserves the right to refuse or terminate services at its discretion when traveler conduct negatively impacts the safety, experience, operations, or well-being of others.

Any costs incurred due to traveler misconduct shall remain the sole responsibility of the traveler.

AGENCY RELATIONSHIP & SUPPLIER RESPONSIBILITY

Travel arrangements coordinated by Over & Beyond Travel LLC are fulfilled by independent third-party travel suppliers. 

Over and Beyond Travel, LLC acts solely as an independent intermediary and sales agent for third-party travel suppliers, including airlines, hotels, resorts, cruise lines, rail providers, transportation companies, excursion operators, and tour suppliers.

Over and Beyond Travel, LLC does not own, operate, manage, supervise, or control any travel supplier or travel service provider and is not a tour operator, transportation provider, or common carrier.

All travel services are provided by independent third-party suppliers who are solely responsible for the delivery of their products and services.

Over and Beyond Travel, LLC shall not be liable for any injury, damage, loss, delay, inconvenience, cancellation, overbooking, supplier default, mechanical failure, acts of negligence, omissions, or other acts of any supplier or third party.

FORCE MAJEURE

Over and Beyond Travel, LLC shall not be liable for delays, cancellations, interruptions, losses, injuries, damages, or expenses resulting from circumstances beyond its reasonable control, including but not limited to acts of God, severe weather, natural disasters, acts of war, terrorism, civil unrest, labor disputes, pandemics, epidemics, transportation disruptions, supplier bankruptcy, government actions, border closures, or travel advisories.

Any refunds, credits, or rebooking options shall be governed solely by the policies of the applicable travel suppliers.

Travelers may consider supplemental evacuation or security coverage for additional protection.

ASSUMPTION OF RISK

Traveler acknowledges that travel involves inherent risks and hazards including, but not limited to:

• illness;
• injury;
• accidents;
• transportation delays;
• supplier failures;
• criminal activity;
• political instability;
• pandemics;
• weather conditions;
• recreational activities;
• and medical emergencies.
   

Traveler voluntarily assumes all risks associated with travel and participation in activities whether booked independently or through third-party suppliers.

Traveler further authorizes emergency medical treatment if deemed necessary during travel and accepts responsibility for related costs.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Over and Beyond Travel, LLC shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to travel services arranged through the Agency.

This includes, but is not limited to:

• emotional distress;
• loss of enjoyment;
• missed connections;
• schedule changes;
• loss of income;
• or additional travel expenses.
   

In no event shall the liability of Over and Beyond Travel, LLC exceed the amount paid directly to Over and Beyond Travel, LLC for professional planning or service fees related to the booking at issue.

BINDING ARBITRATION

Any claim, dispute, or controversy arising out of or relating to this Agreement or the travel services arranged by Over and Beyond Travel, LLC shall be resolved exclusively through final and binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. §§ 1–16.

Arbitration shall be administered exclusively by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules in effect at the time the claim is filed.

The arbitration shall be governed by the substantive laws of the State of Louisiana and shall take place in St. Helena Parish, Louisiana, unless otherwise agreed in writing by the parties. Arbitration may be conducted virtually at the discretion of the Agency.

The arbitrator shall have exclusive authority to determine all issues relating to the interpretation, enforceability, applicability, or formation of this Agreement.

Both parties knowingly and voluntarily waive any right to trial by judge or jury and agree that all disputes shall be resolved solely through binding arbitration.

Claims must be brought in an individual capacity only and not as part of any class action, representative action, collective proceeding, or consolidated claim.

Notwithstanding the foregoing, Over and Beyond Travel, LLC reserves the right to pursue collection matters, unpaid balances, chargeback disputes, or claims eligible for small claims court in a court of competent jurisdiction.

In any action, arbitration, collection matter, chargeback dispute, or proceeding arising out of or related to this Agreement, the prevailing party shall be entitled to recover reasonable attorney fees, arbitration costs, administrative fees, and related legal expenses to the fullest extent permitted by applicable law.

SELLER OF TRAVEL / STATE RESTRICTIONS

Certain states impose Seller of Travel registration or licensing requirements that may affect the availability of travel services. Over and Beyond Travel, LLC reserves the right to limit, decline, or cancel bookings where prohibited or restricted by applicable law.

PHOTOGRAPHY & MEDIA RELEASE

By participating in travel experiences arranged by Over and Beyond Travel, LLC, travelers grant permission for photographs or video recordings taken during travel to be used for promotional, marketing, educational, or commercial purposes without compensation or additional approval.

WEBSITE DISCLAIMER

Information, pricing, availability, products, and services presented on the Agency website may contain errors, inaccuracies, or omissions and may be updated or changed without notice.

Over and Beyond Travel, LLC does not guarantee the completeness, accuracy, or uninterrupted availability of website content and shall not be liable for damages arising from reliance upon website information or inability to access the website.

KNOWING & VOLUNTARY EXECUTION

I acknowledge that I have carefully reviewed and understand these Terms and Conditions and voluntarily agree to be legally bound by them.

I understand that this Agreement includes limitation of liability provisions, assumption of risk provisions, and binding arbitration provisions.

By signing or submitting payment, I agree to these Terms and Conditions on behalf of myself, all members of my traveling party, and any minor children traveling with me.
